JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner is the landlord of an immovable property which is occupied by the respondent. The dispute between them relates to certain money claims by the petitioner and the claim for vacant possession. Mr. Neeraj Sastry, the learned counsel for the petitioner, submits that the parties are in the midst of negotiations, and in fact, the in-principle- understanding is that the respondent will file an undertaking in the pending appeal in Commercial Appeal No.306/2026 with the commercial division of this Court agreeing to vacate and hand over possession of the subject property by 01.07.2026 with the petitioner agreeing to waive all money claims if possession is so delivered. Mr. Abhishek H, the learned counsel who appears for the respondent, when queried in the light - 4 - HC-KAR NC: 2026:KHC:28938 CMP No. 36 of 2026 of these submissions, states that such Affidavit of Undertaking would indeed be filed in the afore proceedings and that the matter is expected to be listed over the next one week. These submissions are taken on record, and the petition stands disposed of because the parties, as is obvious from the above, have agreed to resolve their dispute. However, this Court must observe that the petitioner must be at liberty to seek revival in case the Affidavit of Undertaking as now stated is not filed.
