Serial No. 143 SUPPLEMENTARY CAUSE LIST-1 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) No. 1603/2026 CM No. 4174/2026 Manzoor Ahmad Khoja …Petitioner(s) Through: Mr. Mohammad Umar Mir, Advocate with Ms. Sabiya Hilal, Advocate Vs. Union of India and Others ...Respondent(s) Through: Mr. T. M. Shamsi, Sr. Advocate, DSGI with Ms. Bisma Ali, Advocate CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER 21.07.2026 1. In furtherance of direction of this Court as given in order dated 10.07.2026, Mr. T. M. Shamsi, learned DSGI very candidly comes forward and submits that the vacation of the shop in reference from the use and occupation of the petitioner, which otherwise was on the basis of license granted for a tenure, has taken place not because of any act of omission or commission on the part of the petitioner as a licensee but on account of intervening requirement of the respondents to get shops in the premises vacated for security reasons with a policy decision not to put the said shops for further allocation in near future till the security concerned remains in effect. 2. In view of this stand, this Court finds that the petitioner may not have a cause to maintain this writ petition, however, taint which is attributed to the petitioner in terms of impugned communication No 900/46/Camp dated 22.05.2026 shall be deemed to have been withdrawn by the respondents against the petitioner so as not to prejudice the right of the petitioner in future to apply for allocation of a facility before some other authorities including army authorities. 3. Disposed as such along with connected CM. (RAHUL BHARTI) JUDGE SRINAGAR: 21.07.2026 Imtiyaz Imtiyaz Ul Gani I attest to the accuracy and authenticity of this document 27.07.2026 12:53
