By filing this writ petition, the petitioners have prayed for the following reliefs :-
“(i) For issuance of an appropriate writ(s),
order(s), direction(s) or a writ in the nature of Mandamus directing the respondents to consider the candidature of the petitioners for appointment on the post of Sahayak Acharya, Class-I to V, under Para & Non- Para category, since the petitioners are

qualified candidates and have been called for document verification, wherein, their documents were duly accepted by the JSSC without any objections/discrepancy, but even though, the result of the petitioners has not been declared by the Jharkhand Staff Selection Commission in spite of having the huge number of vacancies. (ii) For issuance of an appropriate writ(s),
order(s), direction(s) or a writ in the nature of Mandamus to show cause the Respondent-JSSSC that why not the results of the petitioners have been declared in- spite of the fact that their documents have been accepted during the document verification procedure without any objections / discrepancy, but their results have not been declared and only the results of 4,333 (Para & Non-Para) candidates have been declared out of total 7,152 shortlisted candidates for document verification against total 11000 vacancies. (iii) For issuance of an appropriate writ(s),
order(s), direction(s) or a writ in the nature of Mandamus to forthwith declare the results of the petitioners as they have been shortlisted for document verification, which was duly attended by all the petitioners without any objections/any show cause issued to them, but the results of the petitioners have been kept in abeyance without assigning any reason in-spite of the availability of huge number of vacancies. (iv) During pendency of the writ application, the seats may be reserved in the name of the petitioners till the final disposal of the instant writ application.”

Heard learned counsel representing the petitioners and
learned counsel representing the respondents.

After hearing the parties and going through the records, I find that the petitioners applied for the post of Trained Graduate Teacher (TGT) (Class-I to V), pursuant to Advertisement No.13/2023, under their respective categories.

During the course of argument, it has been submitted by
learned counsel representing the respondent – JSSC that petitioner No.1 – Rameshwar Mahto, has obtained much lesser marks than the last selected candidate in his subject and category.

Since petitioner No.1 has obtained much lesser marks than the last selected candidate in the category and subject of the petitioner, I am of the opinion that no relief can be granted to petitioner No.1.

However, since it has been admitted that the appointment process is still continuing, be it noted that if in future, it is found that any person obtaining lesser marks than petitioner No.1 in the category and subject of the petitioner No.1 as per the State wise merit list, has been appointed, it will be open to petitioner No.1 to approach the respondent - JSSC by filing a representation showing proof that the person having lesser marks has been appointed. In that event, the JSSC will consider the case of petitioner No.1 and pass appropriate order.

So far as petitioner No.2 – Hiralal Mahto and petitioner No.3 – Sunil Kumar, are concerned, it has been submitted that petitioner No.2 has obtained less than 50% marks in intermediate

and petitioner No.3 has not submitted his teaching certificate within the prescribed time limit.

Considering the aforesaid submission, I direct petitioner Nos.2 and 3 to approach the respondent – JSSC by filing a representation, within four weeks.
9.1. The respondent – JSSC will consider the grievance of respondent Nos.2 & 3 and pass an appropriate order within six weeks from the date of receipt of copy of this order along with the representation.
9.2. If otherwise, petitioner Nos.2 & 3 are found eligible, their case will be considered for recommendation.
9.3. If the claim of petitioner Nos.2 & 3 is rejected, reasons thereof should be communicated to them.

With the aforesaid observation and direction, this writ petition stands disposed of.
