( 2026:JHHC:22593 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Revision No. 333 of 2026 ------- 1. Basu Oraon @ B. Oraon, aged about 15 years 2. Manish Oraon @ M. Oraon, aged about 16 years Both are sons of Manglu Oraon @ Mangla Oraon, both resident of village Halmati, P.O. Belagara, P.S. Ghaghra, District Gumla, represented through their mother Bukhli Oraon. …... …. Petitioner (s) Versus The State of Jharkhand .…. …. Opp. Parties -------- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY -------- For the Petitioner(s) : Mr. Kumar Nishant, Advocate For the State : A.P.P Order No. 02/ Dated 30.07.2026 Heard Mr. Kumar Nishant, learned counsel for the petitioners and the learned A.P.P. This application is directed against the order dated 05.01.2026 passed by learned Additional Sessions Judge-I-cum-Special Judge (Children’s Court), Gumla in Cr. Appeal No.42/2025, whereby and whereunder, the order dated 30.10.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Gumla in M.C.A No.169 of 2025, rejecting the prayer for bail of the petitioners has been affirmed. It has been alleged that the son of the informant had met one Seema Kumari but he did not return. On being asked, Seema Kumari had disclosed about the names of Ankit Oraon and Vikash Oraon, with whom, the son of the informant had gone to take alcohol. Subsequently, however, the dead body of the son of the informant was located from near the river. Submission has been advanced by the learned counsel for the petitioners that the petitioners have been implicated on the basis of confession of co-accused persons. It has further been submitted that Ankit Oraon, who is also alleged to have taken the deceased to have liquor, has been granted bail in B.A. No. 1573/2025. Learned counsel adds that both the petitioners are in custody for about one year and eight months. It has also been submitted that save and except the confessional statement, no other materials have surfaced with respect to the involvement of the petitioners in the commission of murder. -2- Learned A.P.P on behalf of the State has opposed the prayer for bail of the petitioners. It thus seems that petitioners have been implicated only on the basis of confessional statement of the other co-accused persons. The social investigation report though has given the description of the incident but the same seems to be from the confessional statement of the co-accused. On consideration of the aforesaid facts, while setting aside the order dated 05.01.2026 passed by learned Additional Sessions Judge-I-cum- Special Judge (Children’s Court), Gumla in Cr. Appeal No.42/2025 and the order dated 30.10.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Gumla in M.C.A No.169 of 2025, direct that the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Gumla, in connection with M.C.A No.169 of 2025, arising out of Ghaghra P.S. Case No.90 of 2024, subject to the conditions that the mother of the petitioners shall ensure the safety of the petitioners and shall further ensure that they are not permitted to mix with any anti-social elements. This application is allowed. (Rongon Mukhopadhyay, J.) Dated 30/07/2026 BS/-
