CORAM: HON'BLE MRS. JUSTICE ANU SIVARAMAN and HON'BLE MR. JUSTICE VENKATESH NAIK T ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) This commercial appeal is filed challenging the
judgment and decree dated 31.10.2022 in Commercial Original Suit No.697 of 2021 passed by the LXXXVIII Additional City Civil and Sessions Judge (Exclusive Commercial Court), Bengaluru City (CCH-89). The appeal was referred to the Mediation Centre and a memorandum of settlement has been filed before the Court.

2. Sri Shreyas Jayasimha, learned counsel appearing for the appellant, and Sri Mohit U. Jhodaskar, learned counsel for Sri S.V. Giridhara, learned counsel appearing for the respondent, along with their respective parties are present before the Court. The parties have also affixed their signature to the memorandum of settlement before the Mediation Centre. The terms of settlement are as follows:
"1. In view of this settlement the Appellant has already paid a sum of Rs.4,79,272/- (Rupees Four Lakhs Seventy Nine Thousand Two Hundred Seventy Two Only) to the Respondent in full and final settlement of the claim made by the Respondent pursuant to the judgment and decree by way of demand draft bearing No.005366 dated 11.06.2026 drawn on HDFC Bank, Frazer Town Branch, Bengaluru. The Respondent has acknowledged the receipt of the said demand draft as full and final settlement of all its claim in the above case.
2. Both the Parties state that they have no claims against each other in future with respect to the above claim and any other ancillary claim.

3. In so far as rejection of counter claim the Appellants undertakes that in view of the settlement entered in mediation they will not challenge it in future.
4. Both the parties admit that they will not post/publish any post against each other in any social media/forum.
5. The Appellants on entering this settlement agreement request this Hon'ble Court for the refund of court fee Rs.63,340/- (Rupees Sixty Three Thousand Three Hundred Forty Only) and also the deposit amount of Rs.2,23,220/- (Rupees Two Lakhs Twenty Three Thousand Two Hundred Twenty Only) made by the Appellant in compliance of the condition imposed and granting an interim
order dated 16.01.2023 to be paid for which the Respondent have no objection.
6. Both the parties agree to produce authorization letters before the Hon'ble Court along with their proof of identity to enable the Hon'ble Court to record settlement."
3. In view of the settlement recorded between the parties, memorandum of settlement is accepted. This

commercial appeal is disposed of in terms of the memorandum of settlement.
4. Decree shall be drawn up accordingly.
5. Eligible Court-fee and the amount deposited shall be refunded to the appellants on proper identification by the Registry. All pending interlocutory applications shall stand dismissed.
