03/30.07.2026 Heard Mr. Nilesh Kumar, learned counsel for the appellant and learned A.P.P.
This appeal is directed against the order dated 20.04.2026 passed by the learned Sessions Judge, Lohardaga in B.P. No. 38/2026 in connection with Senha P.S. Case No. 117/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that on a raid conducted by the Police, the appellant was apprehended and he had disclosed that he has given some arms and ammunitions to one Shyam Lal Yadav about 2-3 months back. On such information, a raid was conducted in the house of Shyam Lal Yadav and the said Shyam Lal Yadav had pointed out the place where arms and ammunitions were kept by him consequent to which, 02 country made pistols, 82 rounds of INSAS Rifle ammunitions and 03 rounds of the 8mm rifle ammunitions were recovered. It has been submitted by the learned counsel for the appellant that on the confession of Shyam Lal Yadav, arms and ammunitions were recovered. It has further been submitted that the appellant has been implicated on a suspicion that it was he, who had given the said arms and ammunitions to Shyam Lal Yadav. Learned counsel adds that

the appellant is in custody since 06.12.2025 and he does not have any criminal antecedent. Learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that on the joint confessional statement of the appellant and Shyam Lal Yadav, the arms and ammunitions which were kept concealed have been recovered.
Regard being had to the period of custody undergone by the appellant, the absence of any criminal antecedents against the appellant and the fact that the recovery was effected primarily on the disclosure made by Shyam Lal Yadav, we while setting aside the order dated 20.04.2026 passed by the learned Sessions Judge, Lohardaga in B.P. No. 38/2026 in connection with Senha P.S. Case No. 117/2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Lohardaga, in connection with Senha P.S. Case No. 117/2025. This appeal is allowed. (Rongon Mukhopadhyay, J.)
