Learned counsel for the petitioners submits that this interlocutory application has been filed with the prayer to delete the name of the opposite party no.2 as the opposite party no.2 –Suresh Kumar Murmu died sometime around 25th May, 2023. Considering the aforesaid facts and circumstances of the case, prayer is allowed. Registry is directed to delete the name of the opposite party no.2 from the cause title of the criminal miscellaneous petition with red ink and renumber the opposite party no.1 as the sole opposite party. This interlocutory application is disposed of accordingly. (Anil Kumar Choudhary, J.) Cr.M.P. No. 884 of 2026 Heard the parties. This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of Cr.M.P. No.3326 of 2025 to its original file. Learned counsel for the petitioners submits that Cr.M.P. No.3326 of 2025 was dismissed for non-prosecution. It is submitted by the learned counsel for the petitioners that Cr.M.P. No.3326 of 2025 was listed before this Court on 13.03.2026 and the cause list suddenly collapsed as the cases listed from serial nos.36 to 44 were listed under the heading ‘orders with defects’ and from serial nos. 54 onwards, there were tied up matters and in no time, the Hon’ble Court reached serial no.64, hence the learned counsel for the petitioners could not appear in the Court, resulting in dismissal of the said Cr.M.P. No.3326 of 2025. It is then submitted that the non-appearance of the learned counsel for the petitioners was neither deliberate nor intentional. It is next submitted that the petitioners have very good grounds to agitate in the said Cr.M.P. No.3326 of 2025 and unless Cr.M.P. No.3326 of 2025 is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that Cr.M.P. No.3326 of 2025 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, Cr.M.P. No.3326 of 2025 is restored to its original file to the stage at which, it was before its dismissal. List Cr.M.P. No.3326 of 2025 under the appropriate heading after a week before the appropriate Bench. (Anil Kumar Choudhary, J.) 31.07.2026 Sonu-
