The complainant has filed the present complaint alleging wilful disobedience of the order dated 04.12.2024 passed by a Co-ordinate Bench of this Court in W.P.No.12459/2024 (S-KSAT). 2. The said order was to the effect that a Disciplinary Enquiry against the complainant should be completed within an outer limit of three months and if it is not completed, the same would not be proceeded with to the advantage of the complainant. 3. The learned Additional Government Advocate appearing for the accused has handed over a list of dates indicating the events that had transpired after 04.12.2024. The same indicates that - 4 - HC-KAR NC: 2026:KHC:30023-DB CCC No. 586 of 2025 immediately after the order dated 04.12.2024, a charge memo was issued to the complainant. Thereafter, on 24.01.2025, the complainant sought documents relating to the charge memo which were provided on 04.02.2025. The complainant sought time for filing a reply which was furnished on 24.02.2025. On 01.03.2025, a Departmental Enquiry was ordered and an enquiry officer was appointed on the said date. Despite notice to the complainant to appear before the Enquiry Officer, the complainant did not appear. However, the complainant, in the interregnum filed the present complaint on 02.06.2025 and thereafter, on 16.07.2025 filed an application before the Karnataka State Administrative Tribunal (Tribunal) seeking stay of the Departmental Enquiry proceedings. The Tribunal has passed an order dated 16.07.2025 staying the said proceedings. It is noted that an Enquiry Officer was appointed within the period of three months. The departmental Enquiry was not concluded, inter alia, due to the non-appearance of the complainant and the stay granted in the application filed by the complainant before the Tribunal. - 5 - HC-KAR NC: 2026:KHC:30023-DB CCC No. 586 of 2025 4. In this view, we are unable to accept that the accused willfully disobeyed the order dated 04.12.2024 and any proceedings are required to be initiated under the Contempt of Courts Act, 1971.
