JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayers: “a) Issue a writ in the nature of mandamus or any other Writ directing the Learned XV Additional City Civil and Sessions Judge, Bengaluru (CCH-3), to dispose of O.S. No. 6321/2022 (Annexure A) within six months, or within such shorter or longer period as this Hon'ble Court may deem fit in the circumstances of the case; b) Pass such other orders as this Hon'ble Court may deem just, fit and proper, in the interests of justice and equity.” - 3 - HC-KAR NC: 2026:KHC:29100 WP No. 16369 of 2026 2. Learned counsel for the petitioner submits that the suit is pending before the Trial Court and seeks a direction for its expeditious disposal. 3. The suit is of the year 2022 and is pending on the file of the Principal City Civil Court and Sessions Judge, Bengaluru and in the light of the law laid down by the Hon'ble Apex Court, the High Court in a routine manner, cannot issue directions to the Trial Court to dispose of the matter out of turn, as it is for the Trial Court to manage its Board and the Court cannot decide how they have to deal with the cases. 3. In this case, learned counsel has drawn the attention of this Court to the Court proceedings, where time and again, at the request of the counsel for the petitioner, the matter was being adjourned, in fact, once the matter was also dismissed for default. 4. In view of the above circumstances, this Court is not inclined to issue direction to the Trial Court to dispose of the suit within a fixed timeframe. However, the Trial Court is directed to proceed with the matter in accordance with law and - 4 - HC-KAR NC: 2026:KHC:29100 WP No. 16369 of 2026 without granting unnecessary adjournments to either of the parties. 5. Accordingly, this Court is passing the following: ORDER i. The writ petition is disposed of. ii. This Court is not issuing any notice to the respondent as no adverse orders are passed against him.
