Panda Mr. Atanu Ghosh …for the State in item no. 51. 1. The two applications for anticipatory bail arising out of the same P.S case are taken up for hearing together. 2. Learned counsel appearing for the petitioners submits as follows. In CRM (A) 4086 of 2025, the husband of the alleged victim is the petitioner while the petitioners in CRM (A) 4087 of 2025 are the other in-laws. The marriage took place about two years ago. There is no previous allegation of torture. The victim had a mental issue, which led to the incident. 2 3. Learned counsel appearing for the de-facto complainant denies the submissions of the learned counsel for the petitioner and opposes the prayer for anticipatory bail. He submits that the torture was meted out for dowry demand even when the lady was two months in the family way. 4. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the statements of the witnesses, the FIR and the post-mortem report. 5. Considering the above, the other materials available in the case diary and the alleged role ascribed to each of the petitioners, while I am inclined to grant anticipatory bail to the petitioners in CRM (A) 4087 of 2025, the application for anticipatory bail of the petitioner/husband in CRM (A) 4086 of 2025 is rejected. 6. In the event of arrest, the petitioners in CRM (A) 4087 of 2025 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner nos. 1, 3, 4 and 7 shall meet the I.O as and when required. 7. Accordingly, the applications for anticipatory bail being CRM (A) 4087 of 2025 is allowed and CRM (A) 4086 of 2025 stands rejected. 3 8. Further investigation shall be carried out under the supervision of the Deputy Commissioner of Police, (East Division). 9. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Jay Sengupta, J.)
