CMP(M) No. 1480 of 2026 09.09.2026 Present: Mr. Pranay Pratap Singh, Additional Advocate General, for the applicants/ appellants. Keeping in view the averments made in the application, which is duly supported by the affidavit of the official-respondent, the delay of 249 days in filing the appeal is condoned. Application stands disposed of. Appeal be registered. LPA No._______ of 2026 Inter alia contends that on an earlier occasion, artificial/frictional breaks were quashed vide order dated 17.05.2010 (Annexure P-1) and the said period was ordered to be condoned only for the purpose of seniority. Accordingly, work-charge status was granted on 01.01.2005, as per the order dated 28.07.2015 (Annexure R-1), which has wrongly been referred to as the order of regularization. The learned Single Judge on that premise has granted the benefits of arrears of salary to the writ petitioners from 01.01.2008 to 2015 while noting that they were regularized w.e.f. 01.01.2005. It is specifically averred in the reply that arrears of salary had wrongly been paid from 01.01.2005 to 31.12.2007 amounting to Rs.8,24,107/-
in respect of the five writ petitioners. It is submitted that even in the contempt proceedings as such, it was noticed that consideration order had been passed and the proceedings had been closed on 02.11.2015 by the Coordinate Bench and, therefore, the second round of litigation as such, was not permissible. Issue notice to the respondents, returnable for 16.11.2026, on taking steps within one week. The State shall place on record the order of regularization and the order Annexure-RA, as mentioned in the order dated 02.11.2025 passed in the contempt petition. CMP No. ______ of 2026 The operation of impugned judgment/order dated 10.09.2025, passed by the learned Single Judge in CWP No. 2121 of 2022, titled as Tarlesh Bali & Ors. vs. State of H.P. & Ors. is stayed. The application stands disposed of accordingly.
