1. The petitioner has preferred the present petition with the following prayers:- I. Issue a writ, order or direction in the nature of mandamus commanding and respondents to grant 2nd A.C.P. to the petitioners in directing the the year 2014 with their respective date on which they have completed 16 years of their satisfactory service in accordance with the paragraph 3(1)(KHA) of the Government Order dated 05.11.2024. II. Issue a writ, order or direction in the nature of mandamus commanding & directing the respondents to grant 3rd A.C.P. to the petitioners in the year 2024 with their respective date on which they have completed 26 years of their satisfactory service in accordance with the paragraph 3(1)(GA) of the Government Order dated 05.11.2024. 2. It is argued by learned counsel for the petitioner that as per paragraph 3(1)(KHA) and paragraph 3(1)(GA) of the Government Order dated 05.11.2024, the petitioners are entitled for the IInd and IIIrd ACP after completing 16 years and 26 years respectively. It is argued that similarly situated persons have already given the benefit of IInd and IIIrd ACP by the order dated 08.07.2024 and 06.08.2025 passed by the respondent No.2, copy of the same is appended as Annexure No.3 & 2 respectively to the writ petition. On the other hand, it is argued by learned Standing Counsel that in case, the petitioner will submit fresh representation before the respondent No.2/Additional Director General of Police (Establishment) Police Head Quarter, U.P Lucknow, respondent No.2 will take a decision in the matter expeditiously. 4. Heard learned counsel for the parties and perused the record. 5. In the facts and circumstances of the case and without entering into merits of the case, the present petition is disposed of directing the petitioner to submit fresh representation ventilating all his grievances before the respondent No.2/Additional Director General of Police (Establishment) Police Head Quarter, U.P Lucknow along with necessary documents and papers as well as certified copy of this order within a period of three weeks from today.
In case, the petitioner does so, the respondent No.2 will take a decision in the matter expeditiously and preferably within a period of six weeks thereafter strictly in accordance with law. unless there is no legal impediment.
