Petitioner has filed this writ petition seeking following reliefs : “10.1 This Hon'ble may kindly be pleased to call for the records of the case for the kind perusal of this Hon'ble Court. 10.2 This Hon'ble may kindly be pleased to issue an appropriate writ or order and direction to the respondent authority to initiate the proceeding for pay compensation to the petitioner in respect of land categorically mention in the petition. 10.3 Any other relief deemed fit in the facts and circumstances of the case may also be granted.” 2. Learned counsel for the petitioner submits that this writ petition is filed seeking a direction to respondents to pay amount of compensation against the land bearing kh. no.132/5 admeasuring 0.246 hectare situated at Village- Mana which was acquired for National Highway Authority. 3. Learned counsel for respondents No.2 & 3-NHAI would submit that writ petition is filed in the year 2021. After filing of writ petition, subsequently, the amount of compensation is paid to petitioner. NHAI 3 / 4 has deposited the amount of compensation in the account of Land Acquisition Officer. 4. Learned counsel for respondents No. 4 & 5/State would submits that State has filed reply along with documents stating that amount has been paid to petitioner which is apparent from memo/letter written to Manager, IndusInd Bank Ltd. directing transfer of fund in the name of Parasram Sinha (Petitioner) in his bank account number as mentioned therein of Punjab National Bank. This letter is dated 25.01.2023 which is subsequent to filing of writ petition and therefore nothing remains for adjudication in this writ petition. 5. Learned counsel for the petitioner would submit that he has made several attempts to make contact with petitioner. However, he could not able to make contact with him and seek instructions in this regard. 6. I have heard learned counsel for the parties and also perused the documents annexed along with this writ petition. 7. Claim of petitioner in this writ petition is only with regard to disbursement of amount of compensation awarded, against his land subject matter of acquisition. NHAI as also the State along with their reply have filed documents showing that there was a direction to Bank Manager to transfer fund through RTGS or NEFT in the bank account of petitioner along with one Hoshiyar Singh. Bank account number, as also name of Bank is also mentioned and amount to be transferred in the bank account of petitioner is mentioned as Rs.22,74,536/-. 4 / 4 8. In the aforementioned facts of case, in the opinion of this Court, nothing remains for adjudication in this writ petition. I do not find any good ground to continue with this writ petition any further. 9. Writ petition is accordingly disposed of. However, petitioner will be at liberty to file appropriate proceeding before appropriate authority if any grievance still remains. Sd/- (Parth Prateem Sahu) Judge Praveen
