… Petitioner(s).
Versus The Municipal Commissioner, Giridih Municipal Corporation, Giridih, P.O. & P.S.-Giridih, District Giridih.… Respondent(s).
CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Jitendra Kr. Pasari, Advocate For the Respondent(s) : Mr. Shadab Bin Haque, Advocate …......
07 /22.07.2026: Heard the learned counsel representing the petitioner and the learned counsel representing the respondent.
2. In this writ petition the petitioner has made the prayer for disbursement of admitted dues of the petitioner. It is the case of the petitioner that the petitioner was awarded the work which the petitioner has completed but the amount remained due.
3. During course of the arguments today, learned counsels appearing on behalf of the petitioner and the State submit that principle amount has now been paid to the petitioner on
10.07.2026.
4.
Learned counsel for the petitioner claims interest for the delayed payment.
5.
Learned counsel appearing on behalf of the Municipality objects and submits that the petitioner had approached belatedly before this Court thus, he is not entitled for the interest. Further, there was a five years warranty period which ended on December, 2020.
6. Considering the submission of the parties, I find that it is an admitted fact that the warranty period came to an end on December 2020.

7. The petitioner filed a representation but the amount was not paid. Ultimately the petitioner had to file this writ petition on
14.05.2024. The respondents paid the principle amount on 10.07.2026 which clearly suggests that they were liable to pay the amount and their liability was undisputed. This also suggests that the respondents have held the money of the petitioner which the petitioner was entitled to get atleast from 2020 onwards.
8. Thus, I direct the respondents to pay interest @ 6% per annum on the amount from the date of completion of the warranty period till the payment of amount. The interest should be paid within a period of 3 months from the date of receipt of the copy of this order.
9. With the aforesaid direction and observation, this writ petition is disposed of.
