The present writ petition under Article 227 of the Constitution of India has been filed by the petitioner against the order dated 01.05.2026 passed by the Principal District Judge, Balrampur, place Ramanujganj INDRAJEET SAHU Digitally signed by INDRAJEET SAHU Date: 2026.06.22 11:07:14 +0530 2 in Misc. Civil Appeal No.1/2026 whereby the Misc. Appeal filed by the petitioner has been dismissed and the order dated 09.05.2025 passed by Additional Judge to the Court of Civil Judge (Senior Division) Ramanujganj, place at Rajpur, District Balrampur Ramanujganj, in Civil Suit No.16-A/2021 has been affirmed. 2. Learned counsel for the petitioner would submit that since the order of rejection of the application filed by the petitioner under Order 39 Rule (1)and(2) CPC has been affirmed by the appellate court, instead of contesting the rejection of application under Order 39 Rule (1) and (2) CPC, the trial court may be directed to expedite the proceeding of civil suit and decide the same as early as possible. 3. I have heard the counsel for the petitioner and perused the documents annexed with the petition. 4. Considering the restricted submissions made by the counsel for the petitioner, it would be appropriate to direct the trial court to expedite the proceeding of civil suit. Accordingly, the trial court is directed to expedite the proceeding of civil suit No.16-A/2021 pending before the Additional Judge to the court of Civil Judge (Senior Division) Ramanujganj, place at Rajpur, District Balrampur Ramanujganj, and decide the same as early as possible preferably within a period of 8 months from the next date fixed before it. 5.
