This revision petition is filed against the interim maintenance order passed by the trial Court granting an amount of Rs.10,000/- to wife and Rs.10,000/- to the child and directed to pay an interim maintenance till the consideration of Crl.Misc.No.51/2021 and the same is challenged beforethe appellate Court in Crl.A.No.450/2024. The appellate Court also having considered the order passed by the trial Court confirms the same. 3. Learned counsel for the revision petitioner would submits that now the revision petitioner is not working and the company in which he is working is closed and he is able to pay the maintenance amount only in - 3 - HC-KAR NC: 2026:KHC:30473 CRL.RP No. 924 of 2026 respect of child but not to the wife. Further, the counsel submits that the respondent is running tutorial and working in a Private Ltd. Company. 4. Heard the counsel for the revision petitioner and perused the material on record. 5. The very contention of the revision petitioner that he shall only pay maintenance amount in respect of child is not accepted and this is a matter of trial which requires consideration and this petition is filed challenging the order of the trial Court and the appellate Court i.e. granting of interim maintenance to the wife and child. Moreover, during pendency of the matter, this revision is filed and the Criminal Miscellaneous is filed in the year 2021 and the same has to be disposed of on merits. Hence, I find no ground to entertain this revision and it is a matter of trial with regard to financial capacity of the revision petitioner to pay the amount to the respondent even though she was earning.
