For the respondent : Mr. Arun Kaushik, Advocate, vice Mr. Sandeep Dutt, Advocate. _____________________________________________________ Chirag Bhanu Singh, Judge (Oral) On the last date of hearing, learned counsel for the appellant sought permission to withdraw the application for bringing on record the legal representatives (LRs) of deceased appellant Roshan Lal, with liberty to file appropriate application at an appropriate stage.
2. It, however, transpires that appellant Roshan Lal had passed away on 12.10.2016. A copy of the death certificate was
-2- ( 2026:HHC:38299-DB ) annexed along with the application for bringing on record the LRs of the deceased appellant. However, the said application was withdrawn with liberty to file at the appropriate stage.
3. The appellant having died as far back as in the year 2016, the present proceedings, in fact, stand abated, the application for bringing on record the LRs of the deceased appellant having already been withdrawn on 24.08.2026. Consequently, the appeal has been rendered otiose.
4. As a sequel thereto, the appeal is dismissed as having seen abated. The appeal stand disposed off in the aforesaid terms, so also the pending application, if any.
