This petition under Section 483(1)(b) of Bharatiya Nagarik Suraksha Sanhita, 2023 [BNS] is filed with a prayer to relax/modify condition No.(1) imposed by the Court of III Addl. District and Sessions Judge, Bengaluru Rural District, sitting at Anekal in Crl.Misc.No.5622/2025 disposed of on 09.01.2026, 2. Heard learned counsel for the petitioner and learned HCGP appearing on behalf of the respondent/State. 3. Petitioner had approached the Court of III Addl. District and Sessions Judge, Bengaluru Rural District, sitting at Anekal, apprehending his arrest in Crime No.226/2025 registered by Bannerghatta Police Station for - 3 - HC-KAR NC: 2026:KHC:29888 CRL.P No. 7679 of 2026 the offence punishable under Section 309(4) of BNS, 2023. 4. Learned Sessions Judge, vide order dated 09.01.2026 had allowed Crl.Misc.No.5622/2025 and granted anticipatory bail to the petitioner for the aforesaid offences, subject to certain conditions. 5. The condition No.1 imposed by the learned Sessions Judge while granting anticipatory bail to the petitioner herein in Crl.Misc.No.5622/2025, vide order dated 09.01.2026 reads as follows:- "1. The petitioner shall surrender before the Respondent Police Station within 15 days from the date of this Order. If the Petitioner is surrendered before the concerned Police, the Investigating Officer shall complete the interrogation as expeditiously as possible, and on completion of the interrogation and recovery of the material objects if any, the Petitioner shall be released on Bail on the terms and conditions in this Order." - 4 - HC-KAR NC: 2026:KHC:29888 CRL.P No. 7679 of 2026 The petitioner is before this Court seeking modification/relaxation of the aforesaid condition no.1. 6. Learned counsel for the petitioner submits that, since the petitioner had travelled to Rajasthan, he could not return back to Bengaluru and comply with condition no.1 found in the order dated 09.01.2026 passed in Crl.Misc.No.5622/2025. He further submits that the time granted by the learned Sessions Judge to comply with the said condition no.(1) has expired. He submits that, if some reasonable time is granted, the petitioner shall comply with condition no.(1) and co-operate with the police for the purpose of investigation. 7. Learned HCGP appearing on behalf of respondent/State does not seriously oppose the prayer made in the petition to relax/modify condition no.1. 8. Under the circumstances, I am of the opinion that the prayer made by the petitioner in this petition needs to be granted. Accordingly, the following: - 5 - HC-KAR NC: 2026:KHC:29888 CRL.P No. 7679 of 2026 ORDER (i) The petition is allowed. (ii) The condition No.1 imposed by the Court III Addl. District and Sessions Judge, Bengaluru Rural District, sitting at Anekal in Crl.Misc.No.5622/2025 disposed of on 09.01.2026, stands modified and the time granted by the learned Sessions Judge to comply condition no.(1) vide order dated 09.01.2026 in Crl.Misc.No.5622/2025 is extended by a further period of fifteen days from the date of receipt of certified copy of this order." (iii) All other conditions imposed by the Court of III Addl.
