JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed aggrieved by the order passed in I.A.No.3 passed Com.O.S.No.179/2024 by LXXXIX Addl. City Civil and Sessions Judge, Bengaluru, wherein the commercial Court has dismissed the IA that is filed by the defendant under Order VII Rule 10 CPC with cost of Rs.10,000/-. 2. Learned counsel for the petitioner submits that the plaintiff has instituted other two suits and in that the I.A filed on the question of jurisdiction is dismissed, and hence the petitioner has come up before this Court. This Court has set aside the order and directed the court to frame an issue and it shall be decided along with the other issue, after the parties let - 3 - HC-KAR NC: 2026:KHC:30004 WP No. 16105 of 2026 in their evidence. Both the counsel submit that similar order may be passed in this case also. 3. As far as this case is concerned, the Court has not framed the preliminary issue. The court shall frame an issue in this regard and shall decide the same along with the other issues. Accordingly, this court is passing the following: ORDER i. The order dated 10.03.2025 in I.A.No.3 passed in Com.O.S.No.179/2024 by LXXXIX Addl. City Civil and Sessions Judge, Bengaluru is set aside ii. The trial Court shall frame an issue with regard to jurisdiction and shall decide the same along with the other issues. iii. Accordingly the writ petition is allowed. iv.
