1. Heard Ms. Shrishti Upadhyay, learned counsel for the petitioner.
2. By this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks for the following relief(s):
“1. That, Hon’ble Court may kindly be pleased to quash the Complaint Case No. 9098/2024 titled Mohammed Irfan Ullah vs. Damodar Park & Ors. Pending before the Learned Judicial Magistrate First Class, Raipur (C.G) and all consequential
2 proceedings arising in and out of the complaint case No. 9098/2024 alongwith summoning order dated 29.08.2024 so far it relates to the petitioner (Annexure P/1).
2. That, Hon’ble Court may kindly be pleased to declare that the petitioner cannot be held liable under Section 138 of the Negotiable Instruments Act, 1881, as he was not an active partner of the firm at the relevant time, and the alleged cheque was neither issued nor signed by him.
3. That Hon’ble Court may kindly be pleased to pass such other or further orders as may be deemed just, proper, and necessary in the facts and circumstances of the case to secure the ends of justice.”
3. As per the status report received, the trial has already been concluded on
13.12.2025. In view of the same, the relief sought in the present petition has become infructuous as nothing survives for consideration in this petition by this Court.
4. Consequently, the present petition is dismissed as having become infructuous.
