Learned advocate appearing for the petitioner submits that the petitioner is in custody since 18.11.2025 and till date, charges have not been framed as process has been issued against one of the absconding accused persons. Learned advocate submits that there is no possibility of the trial concluding in near future. As such, the petitioner, who is a helper/khalasi of a Truck, may be released on bail. Learned advocate appearing for the State, on the other hand, denies the submission of the petitioner that the petitioner was a helper/khalasi and submits that the petitioner was a coordinator. Be that as it may, the records of the prosecution reflect that the subject-matter of the case relates to alleged recovery of 677.24 kgs. of Ganja. Having considered the huge quantum of recovery effected in the present case, at this 2 stage, I am not inclined to release the petitioner on bail as the provision of Section 37 of the NDPS Act is attracted. Consequently, the prayer for bail of the petitioner is rejected. The learned Trial Court is directed to exhaust the process of law and split up the trial within the statutory provisions of law at the earliest. The application for bail, being CRM (NDPS) 1128 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
