OMP(M) No.458 of 2025 By way of the present application, a prayer has been made to condone the delay, as occurred in filing the accompanying appeal, on the ground that after passing the award by the learned District Judge Bilaspur, the file has been dealt with, at various levels, in the office of the applicant, due to which, the appeal could not be filed within the prescribed period of limitation. Notice issued against the respondent has been received back after due service. Despite service, respondent has failed to put appearance and to contest the application, what to talk of controverting the factual position, as asserted in the application. Considering the said fact, the application is allowed and the delay, as occurred, in filing the main appeal, is ordered to be condoned. The application stands disposed of. Arb. Appeal No. of 2026 Be registered. Admit. OMPST No.57612 of 2025 The application is considered and allowed. During the pendency of the appeal, the execution of the award dated 08.12.2022, passed by the Division Commissioner, exercising the powers of Arbitrator under the National Highways Act, 1956, is ordered to be stayed, subject to deposit of the entire awarded amount, together with upto date interest, within a period of eight weeks.
