In this regard, an appeal bearing No.K.SC.ST(S)Appeal.12/2023-2024 (Annexure- J), is said to be pending on the file of Deputy Commissioner, Tumakuru District. It is further submitted - 4 - HC-KAR NC: 2026:KHC:29580 WP No. 17803 of 2024 that same is not taken up for early hearing. Hence, the writ petition is filed with the following prayer and interim prayer: "1. Issue a Writ of Mandamus or any other appropriate writ, order, or direction directing the Deputy Commissioner, Tumakuru District to expeditiously dispose off the Appeal bearing No.K.SC.ST(S)Appeal.12/2023-24 Annexure-J instituted by the Petitioner before the Court of the Deputy Commissioner, Tumakuru District. 2. Grant any other relief, order, or direction that this Hon'ble Court may deem fit and proper in the circumstances of the case. INTERIM PRAYER The Petitioner respectfully prays that pending final disposal of this Writ Petition, it is respectfully prayed that this Hon'ble Court be pleased to stay the operation and execution of the Order dated 30.08.2021 passed by the Assistant Commissioner Madhugiri Taluk in proceedings bearing PTCLSR 05/2016-17 Annexure-F, in the interest of Justice and Equity." 2. This Court on 12.07.2024 had passed the following interim order: "1. Learned High Court Government Pleader accepts notice for respondent Nos.1 to 3. Issue notice to respondent Nos.4 to 7 returnable by 27.09.2024. - 5 - HC-KAR NC: 2026:KHC:29580 WP No. 17803 of 2024 2. The operation and execution of the order dated 30.08.2021 passed by respondent No.3 / Assistant Commissioner, Madhugiri Taluk in proceedings bearing PTCLSR 05/2016-17 at Annexure-F, is stayed till the next date of hearing. 3. Re-list on 27.09.2024. 4. Process fee and copies to be furnished by the end of the day 16.07.2024, failing which, the interim order granted would stand automatically vacated." 3. When the matter is taken up today, both petitioner as well as learned counsel for the contesting respondent have no objection for a direction to be issued to respondent No.2 - Deputy Commissioner for quick disposal of the appeal in accordance with law. They fairly submit that till such disposal, the interim order granted by this Court can continue. Hence, the following: ORDER i) The Writ Petition is disposed of. ii) The direction is hereby issued to respondent No.2 to expeditiously dispose of the appeal - 6 - HC-KAR NC: 2026:KHC:29580 WP No. 17803 of 2024 bearing No.K.SC.ST(S)Appeal.12/2023-2024 pending on its file. iii) The parties shall co-operate for quick disposal of the appeal. iv) The interim order granted by this Court on 12.07.2024 shall continue till a decision is taken by the 2nd respondent on merits of the case. 4. It is hereby made clear that no opinion is expressed on merits of the case and the 2nd respondent shall dispose of the appeal in accordance with law without being influenced by any of the observations made herein above.
