1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 151/2026 registered at Police Station – Pratappur, District - Surajpur (C.G.) for the offences punishable under Sections 316(3), 316(5) and 3(5) of the BNS,

The prosecution story, in brief, is that on 23.05.2026, the police of Police Station Pratappur received secret information from an informer that the accused persons had transported diesel from Bharat Petroleum ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.06.19 18:39:39 +0530
2 Company, Mugalsarai (U.P.), but had not delivered the same to its intended destination and had instead sold the diesel to one Ravikant Yadav, thereby committing criminal breach of trust against Bharat Petroleum Company. On the basis of the said information, the police personnel conducted a raid at Annapurna Dhaba and allegedly recovered a total of 950 litres of diesel stored in different drums. The police seized the drums containing the diesel, along with the vehicle and tanker involved in the alleged offence. 3. The learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the applicant is a driver by profession. He submits that the applicant is engaged in driving vehicles and transporting diesel and other goods as per the instructions of the vehicle owner. The applicant has never committed any act of criminal breach of trust. He also submits that the applicant has been implicated in the present case solely on the basis of the memorandum statement of co-accused Ravikant Yadav. He submits that no incriminating article has been seized from the possession of the present applicant. He further submits that the present applicant has no criminal antecedents, therefore, he prays for grant of anticipatory bail to the applicant. 4.
On the other hand, learned State counsel opposed the anticipatory bail application of the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions advanced by learned counsel for the parties, and the material available in the case diary, it appears that the present applicant has been implicated primarily on the basis of the memorandum statement of co-accused
3 Ravikant Yadav. No incriminating article has been recovered or seized from the possession of the applicant. Further, the applicant has no criminal antecedents. In view of the aforesaid circumstances, and without expressing any opinion on the merits of the case, this Court is inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Salman Hasmi, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
