JUSTICE M.NAGAPRASANNA) The petitioners have challenged the notification seeking to acquire the lands of the petitioners and in the alternative have sought for compensation to be paid to them under the new Land Acquisition Act, 2013. On the earlier occasion, this Court had directed the petitioners to secure instructions as to whether the petitioners would be willing to take compensation in terms of the scheme i.e., 60:40 ratio, that is now determined for the purpose of grant of compensation in the lands that are acquired for the formation of Dr. Shivaram Karanth layout. 2. The learned counsel Sri. Clifton Rosario appearing for the petitioners would submit that the petitioners are ready and willing for taking compensation in terms of the scheme 60:40 ratio and the petitioners/parties, who are present before the Court also would submit the same. 3. In that light, we deem it appropriate to dispose the subject petition with a direction to the BDA to determine compensation in terms of the scheme 60:40 ratio, as is now determined to all lands that have become the subject matter of acquisition of Dr. Shivaram Karanth layout and disperse the - 4 - HC-KAR NC: 2026:KHC:29007-DB WP No. 932 of 2024 same as expeditiously as possible. Insofar as the sites that are to be given to the land losers, the learned counsel for the petitioners' submit that they be considered for grant of sites in the vicinity of the remaining lands that are now acquired. 4. Learned counsel Sri. Shivaprasad M. Shantanagoudar representing respondent Nos.2 and 3/BDA would submit that a direction to consider a particular site would not be granted, but, in the nearest vicinity as far as possible, the BDA would consider the case of the petitioners and draw up a site accordingly. The said submission is placed on record. In the said circumstance, we deem it appropriate to dispose of the writ petition with the aforesaid directions.
