JUSTICE PARTHIVJYOTI SAIKIA O R D E R 27.01.2026 This is a common order for these two items. Heard Mr. H. Ali and Mr. K. Thakur, the learned counsel appearing for the petitioners. Also heard Mr. K.K. Parasar, the learned Addl. Public Prosecutor, Assam. 2. Both these applications are filed under Section 482 & 483 of the BNSS, 2023 in respect of Chaygaon P.S. Case No.333/2025 under Section 61(2), 316(4) & 318(2) of the BNS, 2023. 3. A truck bearing registration AS-26C-9977, owned by the petitioner Manprit Singh and driven by Sujan Sinha was loaded with 34 mt. of natural rubber. The consignment was to be transported from Tripura to Gujarat. The vehicle crossed through the State of Assam, but never reached the destination. Later on, the truck owner Manprit Singh discovered the empty truck abandoned at a place within the jurisdiction of Chaygaon Police Station. The driver of the truck was missing. The FIR was lodged by Sri Sanjiv Page No.# 3/3 Kumar Das, authorized representative of CJ Darcl Logistics, which dispatched the consignment. The FIR was lodged against the truck owner Manprit Singh, driver Sujan Sinha and the transport broker of “Baba Tara Singh Roadways”. 4. The petitioner Sudip Singh was arrested by police on the ground that during the relevant period, he had telephonic conversations with the driver Sujan Sinha. The truck owner Manprit Singh apprehends that he might be arrested by police because his name is there in the FIR. 5. I have considered the submissions made by the learned counsel of both sides in view of the materials before me. 6. I found that apart from making telephonic conversations with the driver Sujan Singh, there are no other materials available against the present petitioner. He no longer deserves to be detained in custody. His bail application is allowed. 7. The petitioner Sudip Sinha in Bail Application No.66/2026 is allowed to go on bail of ₹25,000/- with a surety of like amount to the satisfaction of Chief Judicial Magistrate, Amingaon. 8. Apart from the fact that Mr. Manprit Singh is the owner of the said truck, there are no other materials against him to justify his detention in custody. He does not deserve to be detained in custody. 9. It is hereby directed that in the event of arrest in connection with Chaygaon P.S. Case No.333/2025, the petitioner Manprit Singh in A.B. No.56/2026 shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority. With the above directions, both the bail applications stand disposed.
