Heard both the sides. Both the bail applications arise out of the same FIR and therefore, heard together and disposed of by common order. These bail applications have been filed on behalf of Asgar Ali and Danish Raza @ Danish Raja who are in custody since 26.10.2025 and 27.10.2025 respectively in connection with Charhi P.S. Case No. 101 of 2025 for the offence registered under Sections 317(5) and 3(5) of the BNS, 2023 and under Sections 15(C), 25 & 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 pending in the Court of learned Special Judge, N.D.P.S. Act, Hazaribagh, is pressed into motion. As per the prosecution case, the matter involves seizure of 201.1 kg of doda stacked in 10 plastic bag which was being carried in a truck bearing registration no. PB06BE6786. The petitioners were apprehended on spot who 2026:JHHC:3409 were escorting truck in another car. It is submitted by the learned counsel on behalf of petitioners that they have no concern with the seized opium and they have been apprehended mainly on suspicion. Learned A.P.P. for the State opposed the prayer for bail and submitted that huge quantity/commercial quantity of opium was seized and they have been arrested from spot who were travelling on Bolero car along with the truck. Petitioners were arrested from spot and considering the huge quantity of opium seized, the prayer for bail of the petitioners, is hereby, rejected. (Gautam Kumar Choudhary, J.)
