The complainant has filed the present petition alleging willful disobedience of the order dated 24.02.2025 passed by the learned - 3 - HC-KAR NC: 2026:KHC:29305-DB CCC No. 1298 of 2025 Single Judge in W.P.No.30258/2024 (BDA). The complainant has filed the said petition, inter alia, praying that BDA be directed to allot six sites as mentioned in the Engineering Section Report dated 04.07.2022, in lieu of acquisition of the complainant's land, measuring 01 acre 15 guntas, comprising Survey No.45/1A1, Kommaghatta Village, Kengeri Hobli, Bengaluru South Taluk. Additionally, the complainant had also prayed that BDA be restrained from allotting site Nos.6803, 6804, 1489, 6756 and 6757 situated at Kommaghatta Village and site bearing No.1429 situated at Bheemanakuppe Village to any third party. The said petition was disposed of by the order dated 24.02.2025, the disobedience in which is alleged. The operative part of the said order reads as under: "1. Petition is disposed of. 2. Respondent - BDA shall consider allotment of sites bearing No.6803, 6804, 6756 and 6757 all situated at Kommaghatta Village, Kengeri Hobli, Bangalore South Taluk and site bearing No.1429 situated at Bheemanakuppe Village in favour of the petitioner. 3. As regard site No.1489 which is already allotted to private respondents in terms of Annexure-K, the respondent-BDA shall consider allotting alternate site along with the aforesaid sites in the same layout. - 4 - HC-KAR NC: 2026:KHC:29305-DB CCC No. 1298 of 2025 4. If the petitioner is found eligible for allotment of sites as above, appropriate orders shall be passed in accordance with law within an outer limit of four months from the date of receipt of certified copy of this order." 2. The learned counsel for the BDA has handed over a memo, enclosing an endorsement dated 15.06.2026, rejecting the complainant's claim for compensation by allotment of sites. The said endorsement is premised on the basis that the complainant had already subdivided the land in question and sold it to 26 separate persons through the GPA Holder. 3. The learned counsel appearing for the complainant submits that the GPA was cancelled and the matter had been settled in another proceeding. He also submits that no person could claim any rights in the complainant’s land after the same had been acquired. He also submits that the BDA sold one of the sites during the course of these proceedings, which was claimed by the complainant. 4. It is relevant to note that the order dated 24.02.2025 does not direct the allotment of any sites; it directs BDA to consider the allotment of the sites as mentioned. The BDA has considered the - 5 - HC-KAR NC: 2026:KHC:29305-DB CCC No. 1298 of 2025 complainant's claim and (rightly or wrongly) rejected it by an endorsement dated 15.06.2026. 5. In view of the above, we do not consider it apposite to initiate further proceedings under the Contempt of Courts Act, 1971. The complaint is accordingly closed. 6. However, we clarify that this order would not preclude the complainant from availing his substantive remedies, including in respect of the endorsement dated 15.06.2026, albeit in accordance with law.
