THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MRS. JUSTICE K.S. HEMALEKHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 25.07.2025, passed by the learned Single Judge of this Court in Criminal Petition No.10758/2025. 2. The learned Single Judge had passed an ad-interim order staying further proceedings in FIR in Crime No.331/2025 pending - 3 - HC-KAR NC: 2026:KHC:30218-DB CCC No. 1575 of 2025 on the file of the learned Principal Civil Judge in CJM Court at Sira, Tumakuru District, till the next date of hearing. 3. Notwithstanding the said order, the accused had completed the investigation and filed the charge sheet. The Court had taken cognizance of the same. 4. The accused has filed an affidavit stating that the order dated 25.07.2025 was not communicated to her, and she was not aware of it. It is also affirmed that she completed the investigation and the charge sheet was prepared on 25.08.2025 and the same was filed in Court on 08.09.2025. The same was accepted on 09.09.2025 and a criminal case was registered in C.C.No.660/2025 on the said date. 5. The accused has admitted that she became aware of the order dated 25.07.2025 on receiving the notice of this contempt petition. She states that on further enquiry, it was found that the order dated 25.07.2025 was communicated to the jurisdictional Court on 05.08.2025 (incorrectly the same is mentioned as 17.11.2025 in the compliance affidavit). She further affirmed that after receiving intimation of the order, she had not taken any steps. - 4 - HC-KAR NC: 2026:KHC:30218-DB CCC No. 1575 of 2025 It is also affirmed in the affidavit that the further proceedings before the jurisdictional Court also stand still. 6. In view of the above, we are not persuaded to accept that there is willful disobedience of the order and the disobedience of which is alleged, warranting any proceedings for the Contempt of Courts Act, 1971 to be initiated against the accused.
