Kausik CRM (R) 161 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ghola Police Station Case No. 316 of 2024 dated 07.10.2024 under Section 8 of the POCSO Act, 2012. And In the matter of : XXXX ……Petitioner. Mr. Nilanjan Adhikari Ms. Oindrila Sinha ……for the Petitioner. Mr. Arindam Sen Ms. Pritha Paul ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 510 days and he has instructions that the evidence of the victim was in progress. Learned advocate for the State, on the other hand, opposes the prayer for bail and produces the case diary. I have taken into account the statement of the victim under Section 183 of the BNSS. Having regard to the merits of the case, I direct the learned Trial Court to release the petitioner on bail after the evidence of the victim is over. 2 Learned Trial Court for this purpose would take into account the period of detention and if required would on the next date so available complete the evidence of the victim (if not already completed). The bond to be furnished and the conditions to be imposed would be decided by the learned Special Court itself for ensuring the appearance of the accused further before the Trial Court and also to see that there is no tampering of evidence concerned. With the aforesaid observations CRM(R) 161 of 2025 is disposed of. Report submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
