For the reasons stated in the application, I.A.No. 1 of 2023 is allowed and delay in filing the instant criminal miscellaneous petition is hereby 2 condoned. 3. Heard on application for grant of leave to appeal filed under Section 419(4) of Bhartiya Nagrik Suraksha Sanhita, 2023. 4. The finding recorded by the learned trial Court goes to show that if the accused has assaulted the victim by iron rod for more than 6 – 10 times, bone will not be broken. The reason assigned by the learned trial Court, prima facie is contrary to the provisions of the Section 324 of the Cr.P 5. On due consideration, application for grant of leave to appeal is allowed. Registry is directed to register the case as regular Acquittal Appeal. 6. Notice be issued to the respondent by ordinary course as well as by registered mode within two weeks on payment of process fee after registration of acquittal appeal. 7. In view of the above, present CRMP stands disposed of. 8. The acquittal appeal be listed on 15-7-2026 for final disposal in motion hearing stage.
