This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.141/2026 registered at Police Station –Nawagarh District: Janjgir- Champa, (C.G.) for the offence punishable under Sections 316(5), 61(2) of Bhartiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that a case has been registered against applicant for committing an offense punishable under sections 316(5) and 61(2) of the BNS, 2023, alleging that he, along VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.06.19 19:46:21 +0530 2 with co- accused Omkar Prasad Patel and Nishikant Patel, committed criminal breach of trust by embezzling a total amount of ₹31,21,551/- from the Service Cooperative Society Limited, registered under Tulsi Registration Number 491, at the procurement center in Kirit, District Janjgir-Champa (Chhattisgarh) in 2025-26 and the official website of Chhattisgarh Police has shown the case as sensitive and therefore the copy of F IR has not been uploaded on the website Annexure A/2 is the Webcopy of the Information. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. She further submits that the as a laborer (Hamal) applicant was engaged under a contract dated 15.11.2025 with the Service Cooperative Society Ltd., Tulsi (Procurement Centre, Kirit) for paddy procurement operations and had deposited a security amount of 2,00,000/-. During his 15-day ₹ absence in December 2025 for his uncle’s medical treatment, procurement activities were managed by the procurement in-charge, computer operator, and other porters. Upon returning in January 2026, he was informed that his services were no longer required and that the procurement work would be handled by others. It is contended that the applicant has been implicated merely on suspicion without any concrete evidence, and therefore he deserves to be granted anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail to the applicant and submits that applicant has no criminal antecedent. 5. I have heard learned counsel for the parties and perused the materials available on record. 3 6. Considering the submissions advanced by learned counsel for the applicant, the nature of allegations, the material available on record, and the fact that the applicant was engaged merely as a laborer (Hamal) under a contractual arrangement and had remained absent during the relevant period owing to his uncle's medical treatment, coupled with the contention that the procurement activities were being managed by other officials and workers during his absence, without expressing any opinion on the merits of the case and considering the overall facts and circumstances of the matter, this Court finds it to be a fit case for grant of anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Deepak Kumar Kashyap on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
