The petitioner claims that because of old animosity with the respondents No. 15 to 21, these respondents committed theft in his house on 21.12.2024 and some wood worth Rs. 3000/- were stolen. On 16.01.2025, the handpump installed in his house was also got stolen alongwith iron pipe amounting to Rs. 20,000/-. On 27.10.2024, the door of the petitioner was broke open and again a theft of articles amounting to Rs.1000/- was committed by these respondents. The said incidents were duly reported to the Police Station, Torwa, District Bilaspur by the petitioner. However, no FIR was registered against the respondents against whom the petitioner had raised suspicion. 4 The petitioner, appearing in person submits that he had left no stones unturned to get the FIR registered as he made phone calls, whatsapp messages, e-mails, written communications to various higher authorities of the Police Department, but a cursory enquiry was made by the police and a false and bogus report was prepared and the matter was consigned to records and no action whatsoever has been taken against the respondents No. 15 to 21 and till date, no FIR has been registered. According to the petitioner, the Superintendent of Police Bilaspur as well as the City Superintendent of Police have prepared false and bogus enquiry report and are not taking any action against the suspects. He prays that the reports prepared by the Superintendent of Police as well as the City Superintendent of Police be examined by the Central Bureau of Investigation and action be taken against the police officials also who 8 are in hand in glove with the accused persons. Hence, this petition seeking for the reliefs as aforesaid. 5 On the other hand, Mr. Priyank Rathi, learned Government Advocate appearing for the State/respondents No. 1, 2, 3, 5, 8, 9, 10, 11, 12 submits that in the police has conducted a preliminary enquiry in which nothing has been found against the respondents No. 15 to 21 and the petitioner himself has been found to have been making false and baseless allegations on regular intervals and as such, this petition deserves to be dismissed outrightly. Mr. Rati further submits that so far as registration of FIR against the suspects is concerned, the said grievance of the petitioner can be very well redressed before the Court below by filing an application under Section 156 (3) or 200 Cr.P.C {now Section 175(3) or 223 of the BNSS}. He further submits that the controversy involved in the present matter has already been decided by the High Court of Allahabad in Misc. Bench No. 24492 of 2020 (Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others) vide judgment and order dated 14.12.2020 as well as by this Court in WPCR No.333 of 2020 (Akhilesh Agrawal v. State of Chhattisgarh & Others) decided on 12.04.2023, dismissing the said petition, hence, the present petition be also dismissed in terms of the said order. 8. We have heard the petitioner appearing in person, learned Government Advocate for the State respondents, and have carefully perused the pleadings, documents placed on record, and the reliefs sought in the present writ petition. 9. At the outset, it is evident that the principal grievance of the petitioner pertains to the alleged theft incidents said to have occurred on different dates and the consequent non-registration of FIRs against the 9 respondents No.15 to 21. The petitioner also seeks initiation of criminal proceedings against several police officers, departmental action against them, suspension of officers holding public posts, transfer of officials, production of records, preservation and production of CCTV footage, and a direction for investigation by the Central Bureau of Investigation. 10. The reliefs claimed by the petitioner travel far beyond the scope of judicial review under Article 226 of the Constitution of India. The extraordinary writ jurisdiction is intended to ensure enforcement of legal and fundamental rights and to correct jurisdictional errors or manifest illegality. It is not intended to convert the High Court into an investigating agency or a supervisory authority over every stage of police administration and criminal investigation. 11. The core allegation of the petitioner is that despite lodging complaints regarding theft, the police authorities have not registered an FIR against the persons suspected by him. The law on this issue is well settled. Where a person is aggrieved by non-registration of an FIR or by an alleged improper investigation, efficacious statutory remedies are available under the criminal law. The petitioner may approach the jurisdictional Magistrate by invoking the provisions of Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 156(3) Cr.P.C.) and may also pursue a complaint case under Section 223 of the BNSS (formerly Section 200 Cr.P.C.). These remedies have been specifically designed by the legislature for redressal of such grievances. 12. It is a settled principle that when an effective and adequate statutory remedy is available, the writ jurisdiction of the High Court ordinarily ought not to be invoked. The petitioner has not demonstrated any exceptional circumstance warranting bypassing of the statutory mechanism provided 10 under criminal law. Mere dissatisfaction with the action taken by the police cannot be a ground for invoking the extraordinary jurisdiction of this Court. 13. The petitioner seeks directions for registration of FIRs against several police officers and private respondents for a large number of offences under different enactments. Such a prayer is founded entirely on the petitioner's personal allegations and suspicions. Whether any offence has been committed, whether any person is liable to be prosecuted, and whether sufficient material exists for registration of a criminal case are matters which fall within the domain of the competent investigating agency and the jurisdictional Magistrate. This Court, in exercise of writ jurisdiction, cannot undertake a roving enquiry into disputed questions of fact requiring collection and appreciation of evidence. 14. The petitioner has also sought a direction for CBI investigation into the alleged conduct of police officers and into the enquiry reports prepared by them. It is trite law that a direction for investigation by the Central Bureau of Investigation cannot be issued as a matter of routine or merely because a litigant has expressed dissatisfaction with the outcome of a preliminary enquiry. Such directions are issued only in exceptional situations where the Court finds compelling circumstances indicating failure of justice, extraordinary public importance, or circumstances demonstrating that a fair investigation is impossible through ordinary agencies. No such material has been placed before this Court. 15. Equally untenable are the prayers seeking suspension, transfer, disciplinary action, and criminal prosecution of various police officers. Matters relating to service conditions, disciplinary proceedings, and administrative control over public servants lie primarily within the domain 11 of the competent authorities under the applicable service rules. In the absence of any adjudicated misconduct or legally established wrongdoing, this Court cannot issue writs directing suspension or transfer of officers merely on the basis of allegations levelled by a complainant. 16. The petitioner has further questioned the correctness of the enquiry reports prepared by the Superintendent of Police and other officers. The correctness or otherwise of such reports involves disputed factual issues which cannot be adjudicated in proceedings under Article 226 of the Constitution. A writ court does not function as an appellate forum over preliminary police enquiries nor can it embark upon an examination of factual controversies requiring oral and documentary evidence. 17. The pleadings reveal that the petitioner has named respondents No.15 to 21 primarily on the basis of suspicion arising out of previous enmity. Mere suspicion, however strong, cannot take the place of legal proof. Criminal law must proceed on the basis of material and evidence and not on conjectures or assumptions. Whether the persons suspected by the petitioner are involved in the alleged incidents is a matter to be determined by the competent forum in accordance with law. The various ancillary prayers seeking production of records, CCTV footage, separate replies from each respondent, award of litigation expenses, and other consequential reliefs are dependent upon the maintainability and success of the substantive reliefs sought by the petitioner. Once this Court finds that the principal grievances are required to be agitated before the competent statutory forum, no independent consideration of such ancillary prayers is called for in the present proceedings. 12 19. We also find substance in the submission of learned Government Advocate that the controversy involved in the present matter stands covered by settled legal principles holding that a person aggrieved by non-registration of FIR or by an alleged defective investigation must avail the remedies available before the Magistrate rather than invoke the writ jurisdiction of the High Court in the first instance. In view of the availability of efficacious alternative remedies under the criminal law, absence of exceptional circumstances warranting interference under Article 226 of the Constitution, existence of disputed questions of fact, and the impermissibility of granting the wide-ranging reliefs sought in the present petition, we are of the considered opinion that no case for interference is made out. 21. Accordingly, the writ petition being devoid of merit deserves to be and is hereby dismissed. It is, however, observed that the petitioner shall be at liberty to avail such remedies as may be available to him in law before the competent forum. No order as to costs.
