ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs: i) Call for records in SC No.288/2023 on the file of the VII Additional District and Sessions Judge, Mysuru for the offences under Section 376, 417, 504, 506 and 509 of IPC; ii) Quash the impugned proceedings in SC No.288/2023 on the file of the VII Additional District and Sessions Judge, Mysuru for offences punishable under Section

376, 417, 504, 506, and 509 IPC produced at Annexure-E; and iii) Grant such other relief or reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity."
2. A joint memo dated 27.04.2026 has been filed, which reads as under:
" JOINT MEMO OF SETTLEMENT The Petitioner and the Respondent No.2 above submits as under:
a. The Petitioner has filed the present Petition seeking to quash the proceedings in SC No. 288/2023 pending before VII Additional District and Sessions Judge, Mysore for the offences punishable under Section 376, 417, 504, 506, 509 of IPC. b. The parties, who are colleagues in the Police Department, submit that with the intervention of well- wishers and elders, they have resolved all their differences and reached an amicable settlement regarding the dispute in S.C. No.288/2023. c. That since the dispute existed between the petitioner and respondent No.2 is amicably settled and compromised out of Court as aforesaid. The is no necessity of further continuance of proceedings as against the Petitioners as the dispute is settled between the parties. The dispute existed between the parties were purely personal in nature and no matter of public policy is involved. d. That the respondent No.2 explicitly clarifies that the relationship between the parties was purely consensual and based on mutual companionship over a long period. Both parties were mature adults and aware of their actions during the subsistence of the relationship. e. That the respondent No.2 submits that she has no further grievances against the petitioner and no longer wishes to pursue the prosecution. She has no objection to this Hon'ble Court quashing the entire proceedings in

S.C. No.288/2023 pending before the VII Additional District and Sessions Judge, Mysuru.
f. That continuing the proceedings would amount to an abuse of the process of law and cause unnecessary hardship to both parties, especially given their professional standing. Quashing the proceedings is necessary to secure the ends of justice and preserve the social and professional harmony of the parties. WHEREFORE, the petitioner and respondent No.2 pray that this Hon'ble Court may be pleased to take this Joint Memo on record and quash the proceedings in S.C. No.288/2023 for the offences punishable under Sections 376, 417, 504, 506 and 509 of IPC, in the interest of justice and equity."

The proceedings in Crime No.137 of 2020 had been initiated on the basis of a complaint filed by respondent No.2 for the offences under Section 376, 417, 504, 506 and 509 of Indian Penal Code (for short, 'IPC'). The petitioner and respondent No.2, both being serving officers as Police Sub-Inspectors of the Police Department. The allegation of respondent No.2 is that the petitioner by assuring to get married her, had sexual relationship and when the marriage did not take place, the aforesaid complaint came to be filed. - 5 -

A perusal of the joint memo filed today indicates that the dispute between the petitioner and respondent No.2 is amicably settled and that respondent No.2 does not wish to prosecute the petitioner. She has categorically stated that the relationship between the parties were purely consensual and based on mutual companionship over a long period. Both being mature adults were aware of their actions during the subsistence of the relationship. It is categorically stated that respondent No.2 has no further grievance against the petitioner and she no longer wishes to pursue the prosecution. 5.
Apart from the joint memo which is filed, what can be seen is both the petitioner and respondent No.2 are majors and are responsible officers working as Police Sub-Inspectors in the Police Department aware of the consequences of all their actions. Petitioner is stated to be married while respondent No.2 is unmarried. Hence, it could not also be expected by

respondent No.2 that during the pendency of the marriage of the petitioner, the petitioner would get married to respondent No.2 and on that basis involved in a sexual relationship. Looked at from any angle the relationship appears to be purely consensual. There is no force or coercion or undue influence in reaching out the terms mentioned in the joint memo. 6. In that view of the matter, I am of the considered opinion that there would be no purpose served with the prosecution being permitted in as much as the complainant does not wish to prosecute and lead evidence against the petitioner. Hence, I pass the following:
ORDER i) Criminal Petition is allowed. ii) The proceedings in SC No.288 of 2023 pending on the file of the VII Additional

District and Sessions Judge, Mysuru arising out of Crime No.137 of 2020 registered by the First respondent police station is hereby quashed.
