1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the applicants, who are apprehending their arrest in connection with Crime GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.06.19 13:23:16 +0530
2 No.189/2025 registered at Police Station – Hirri, Distt. Bilaspur, Chhattisgarh for the offence punishable under Sections 303 (2), 3(5) of BNS.

Case of the prosecution, in brief, is that on August 8, 2025, the complainant, Ganga Sahu, filed a report at Hirri Police Station stating that on the night of August 8, 2025, at approximately 3:00 AM, he had parked his trailer truck, bearing registration number CG 30 H-2900, on the side of the Amsena service road due to it being nighttime and was sleeping in the cabin he heard a noise outside the vehicle and looked out through the cabin window. He saw 2-3 people getting out of a white Scorpio vehicle, registration number CG 12 BP-6047. They broke the fuel tank cap of his trailer, inserted a pipe, and began siphoning diesel. He remained silently in the cabin out of fear. After they left, he got down and checked, finding that approximately 60-70 liters of diesel had been stolen from his trailer's fuel tank. Based on the complainant's information, a case was registered, and the Scorpio vehicle, registration number CG 12 BP-6047, was intercepted and apprehended. However, the occupants of the vehicle managed to escape.

Learned counsel for the applicants submits that the applicants are innocent and they have been falsely implicated in this case. He would submit that co-accused Shubham Kumar Kurre whose bail application has been rejected by this Court on 14/01/2026 vide MCRCA No.74/2026 has preferred SLP (Crl.) No.3828/2026 before the Apex Court which has been allowed on 04/05/2026. He would submit that the applicants are ready to furnish adequate surety and shall abide by
3 all the directions and conditions which may be imposed by this Court, applicants are permanent resident of address mentioned in the cause title and there is no chance of their absconding, therefore he prays to enlarge the applicants on anticipatory bail.
4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail but do not dispute the fact that co-accused person has been granted bail by the Apex Court.
5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the parties, materials available on record, considering the nature of allegation levelled against the applicants, also considering the fact that co-accused Shubham Kumar Kurre whose bail application has been rejected by this Court on 14/01/2026 vide MCRCA No.74/2026 has preferred SLP (Crl.) No.3828/2026 before the Apex Court which has been allowed on 04/05/2026 and also considering the fact that investigation and trial are likely to take some time, therefore, I am inclined to grant anticipatory bail to the present applicants.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Sukumar & Sangram Singh Ratre, on each of them executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:-
4 (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicants shall not involve themselves in any offence of similar nature in future. Sd/-
