IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.3644 of 2026
Abakash Samal … Petitioner
Mr. R. Mohanty, Advocate
-versus- State of Odisha … Opposite Party Mr. P. Satpathy, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) : 29.06.2026
03. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Patkura P.S. Case No. 151 of 2022 corresponding to S.T. Case No. 70 of 2023 (G.R. Case No. 666 of 2022) pending in the file of learned Sessions Judge, Kendrapara, for commission of offences punishable U/Ss. 498-A/304-B/406/306/34 of IPC r/w. Sec. 4 of DP Act, on the main allegation of committing dowry death and abetment of commission of suicide of his wife by subjecting her to torture and cruelty for demand of dowry, along with co-accused persons in furtherance of their common intention. 2. Heard, Mr. Ranjit Mohanty, learned counsel for the petitioner and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record. 3. Admittedly, the petitioner is in custody since 10.04.2022, but in the meantime, more than four years have elapsed, however, the trial is yet to be concluded. Besides, the bail application of the petitioner was earlier rejected on 27.10.2025 and by then, 21 witnesses have been examined, however, in the meantime, only four more witnesses have been examined, which suggests the slow progress of trial in
this case. In the aforesaid facts and circumstances and taking into account the punishment prescribed for the offences and keeping in view non-conclusion of trial even after more than four years custody of the petitioner and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit, admits the petitioner to bail. 4. Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) the petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with and he shall cooperate the Court during the trial.
In case the Petitioner fail without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
