No. 133/2025 pending before the Court of I Additional District and Sessions Judge at Mandya, arising out of Crime No.74/2025 registered by Keragodu Police Station, Mandya, for the offences punishable under Sections 126(2), 352, 115(2), 118(1), 118(2), 109 of the Bharatiya Nyaya Sanhitha, 2023 (hereinafter referred to as 'BNS, 2023' for short) is before this Court in this criminal petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned Additional SPP for the respondent/State. 3. FIR in Crime No. 74/2025 was registered by Keragodu Police Station, Mandya, for the aforesaid offences against the petitioner herein based on the first

HC-KAR NC: 2026:KHC:29915 CRL.P No. 4454 of 2026 information dated 03.07.2025 received from Smt. Padmamma, mother of the injured victim - Kumara A N. In the said case, petitioner was arrested on 19.09.2025 and remanded to judicial custody. After completing investigation, charge sheet was filed against him for the aforesaid offences. His bail application filed before the trial Court in Crl.Misc. No. 912/2025 was rejected on
22.11.2025. Therefore, he is before this Court. 4. In respect of the incident that had taken place at about 9.00 p.m. on 01.07.2025, first information has been submitted in the present case belatedly on 03.07.2025 by the mother of the injured victim. During the course of investigation, petitioner was arrested on
19.09.2025. After completing investigation, charge sheet has been filed and in the said charge sheet, it is alleged that on 01.07.2025 at about 9.00 p.m., in the shop belonging to one Narayana, the accused - petitioner had demanded money from the injured victim (C.W.2) for the purpose of consuming alcohol. Since the victim did not pay

HC-KAR NC: 2026:KHC:29915 CRL.P No. 4454 of 2026 him the money he allegedly had assaulted him with his hands and thereafter picked up a pair of scissors from the shop and assaulted with the same on the right eye of the victim and as a result, victim suffered a grievous injury on the right eye and lost his vision. 5.
It is not the case of the prosecution that petitioner had any ill-will or vengeance as against the victim and on the other hand, incident had taken place after the victim allegedly had refused to pay money to the petitioner for consuming alcohol. Therefore, it is apparent that the act of the petitioner was not premeditated and undisputedly, petitioner had picked up a pair of scissors from the shop and had assaulted the victim with the same. It is not in dispute that the petitioner has no other criminal antecedents. The victim who was admitted in the hospital has been discharged and his condition is stable. Petitioner is in custody for the last nearly 9 months. - 5 -

6. In view of the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C. No. 133/2025 pending before the Court of I Additional District and Sessions Judge at Mandya, arising out of Crime No.74/2025 registered by Keragodu Police Station, Mandya, for the offences punishable under Sections 126(2), 352, 115(2), 118(1), 118(2), 109 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

HC-KAR NC: 2026:KHC:29915 CRL.P No. 4454 of 2026 b) The petitioner shall appear regularly on all the date of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
