NJS,J W.P No.22074 of 2013 2
The Court made the following Order:
Though at the time of considering the matter, it noted that the learned counsel for the petitioner is no more, this Court is inclined to dispose of the writ petition, in the light of the averments made in the counter-affidavit filed by the respondent No.1.
2. The writ petition is filed seeking to declare the action of the respondent No.1 in disconnecting the power supply to the Service Connection No.1001037806 as illegal, arbitrary, etc., and for consequential direction to restore the same.
3. In the counter-affidavit filed by the respondent No.1 at Para No.5 inter alia as follows:-
“…It is submitted that the disputed service connection was cancelled as per the request of the petitioner with effect from 25.09.2017 and the present status of the service is under permanent dismantlement and no arrears are outstanding against the Service connection. The above writ become infructuous since there is no claim for adjudication before this Hon’ble Court since pending writ, the impugned Service Connection has been cancelled by the petitioner without any protest voluntarily”.
4. In the light of the above stated position, the cause in the writ petition does not survive for adjudication.
5. Accordingly, the Writ Petition is closed. No costs. Miscellaneous petitions pending, if any, shall stand closed. __________________________ JUSTICE NINALA JAYASURYA Date:10.03.2026 Ksj
