The petitioner is before this Court seeking for the following reliefs: i) Issue writ or order or direction in nature of certiorari to quash the impugned E-tender notification called out by the second respondent vide Tender Notification No.Sa.Ni/U.Sa.Kri.E/Shi.E-Tender-2025-26 dated 23-03-2026 for supply of Manpower services on outsource basis to the 2nd respondent as per Annexure-H. ii) Issue writ of mandamus or order or direction in directing the respondent No.2 to issue work order infavour of the petitioner with immediately. iii) or direction or any other order/s or direction deems fit to the facts and circumstances of the case and to meet the interest of justice. 2. The grievance of the petitioner is that on two earlier occasions, the tender for the very same purpose had been cancelled and now a third tender has been issued. The apprehension on the part of the petitioner is that - 3 - HC-KAR NC: 2026:KHC:29650 WP No. 11559 of 2026 this tender could also be cancelled and in that background the petitioner is before this court seeking for the aforesaid reliefs. 3. Learned AGA has filed a compliance affidavit of the Assistant Director, Department of Youth Empowerment and Sports, Shivamogga, placing on record certain documents. The first tender having been issued on 18.01.2025 was cancelled on 30.09.2025 on the ground that there is a defect in the tender documentation in terms of the amount being mentioned. The second tender was issued on 06.10.2025, which came to be cancelled on 18.12.2025 on the ground that certain documents had not been produced by one of the tenderers. Subsequently, a fresh tender has been issued on 23.03.2026 as regard which the petitioner has participated. 4. Though the earlier two tenders had been cancelled, the first cancellation having occurred on 30.09.2025, the second cancellation having occurred on 18.12.2025, the petitioner did not approach this court at that time, - 4 - HC-KAR NC: 2026:KHC:29650 WP No. 11559 of 2026 but approached this court only on 02.04.2026, after the issuance of the third tender notification, in which the petitioner has already participated. The petitioner having already participated in third tender, the same would be required to be proceeded as per the applicable tender norms. 5. The petition now filed to challenge the third tender notification in which the petitioner has participated without challenging the earlier two cancellation orders would not survive for consideration. The petition stands dismissed. 6. The respondents are put on notice that they have to complete the tender process this time by following the applicable procedure.
