Koley … for the WBSEDCL Ms. Indrani Chakraborty Ms. Sarda Sha … for the State The grievance of the petitioner is directed against non-payment of compensation. It is submitted on behalf of the petitioner that her husband had suffered a fatal electric shock while operating the electricity switch at her premises. The petitioner complains of leakage of electricity which has caused such serious injury. The petitioner husband being 70% handicapped and subsequent death due to the grievous injury caused by the electricity leakage has prejudiced the livelihood of the petitioner. On behalf of WBSEDCL, it is submitted that there has been no negligence nor any act of omission or commission on their part insofar as 2 the above incident is concerned. More importantly, such accident had occurred at the premises of the petitioner over which WBSEDCL has no control nor authority. There is no enforceable legal right which the petitioner has been able to demonstrate even warranting a prayer for consideration. In such circumstances, the entire claim of the petitioner is baseless, speculative and misconceived. WPA 11193 of 2026 stands dismissed. There shall, however, be no order as to costs.
