Accused in Spl.C.No.11/2025 pending before the Court of Principal District and Sessions Judge, D.K., Mangaluru, arising out of Crime No.46/2015 registered by Ullal Police Station, D.K., Mangaluru, for offences punishable under Section 8(c) and 20(b) of Narcotic Drugs and Psychotropic Substances Act, is before this Court in the successive bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel appearing for the petitioner and learned HCGP for the respondent-State. 3. FIR in Crime No.46/2015 was registered by Ullal Police Station, D.K. Mangaluru, against the petitioner and - 3 - HC-KAR NC: 2026:KHC:30278 CRL.P No. 2579 of 2026 another for the aforesaid offences and in the said case he was arrested on 14.02.2015 and subsequently, released on bail by this Court in Criminal Petition No.3155/2015 dated 22.06.2015. It appears that the petitioner had not appeared before the Trial Court in Spl.C.No.52/2015 and therefore, a split-up case was directed to be registered against him and coercive action was taken as against him for securing his presence. Subsequently, on 21.01.2025 he was arrested and remanded to judicial custody and the split up case is now pending against him in Spl.C.No.11/2025. The bail application filed by him in the said case was dismissed by the Trial Court on 01.07.2025. Therefore, he is before this Court. 4. It is not in dispute that on the merits of the case, the petitioner was granted regular bail by this Court in Criminal Petition No.3155/2015 dated 22.06.2015. 5. The material produced by the learned counsel for the petitioner would go to show that the accused No.2 in the - 4 - HC-KAR NC: 2026:KHC:30278 CRL.P No. 2579 of 2026 present case, who was tried in Spl.C.No.32/2016 by the Trial Court for the aforesaid offences with similar allegations, has been acquitted. The petitioner is in custody from 21.01.2025 onwards for the reason that he had not appeared before the Trial Court regularly on the dates of hearing. For the mistake committed by the petitioner, he has been now sufficiently punished. He has undertaken to cooperate before the Trial court for speedy disposal of the case. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Spl.C.No.11/2025 pending before the Court of Principal District and Sessions Judge, Dakshina Kannada, Mangaluru, arising out of Crime - 5 - HC-KAR NC: 2026:KHC:30278 CRL.P No. 2579 of 2026 No.46/2015 registered by Ullal Police Station, for offences punishable under Section 8(c) and 20(b) of NDPS Act, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
