JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.3 in S.C.No.135/2025 pending before the Court of I Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.10/2025 registered by the Bengaluru Rural Railway Police Station, for the offences punishable under Sections 103, 238 read with Section 3(6) of the Bharatiya Nyaya Sanhitha, 2023 (hereinafter referred to as 'BNS, 2023' for short) is before this Court in this criminal petition filed - 3 - HC-KAR NC: 2026:KHC:29517 CRL.P No. 922 of 2026 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned Additional SPP for the respondent/State. 3. FIR in Crime No. 10/2025 was registered by Bengaluru Rural Railway Police Station for the offences punishable under Sections 103 and 238 of BNS, 2023 against unknown persons based on the first information dated 20.02.2025 received from Yogesh K R, Police officer attached to Bengaluru Rural Railway Police Station. During the course of investigation, petitioner herein was arrested on 12.03.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against 3 persons and petitioner is arraigned as accused No. 3 in the charge sheet. His bail application filed before the trial Court in Crl.Misc.No. 2483/2025 was rejected on 13.01.2026. Therefore, he is before this Court. - 4 - HC-KAR NC: 2026:KHC:29517 CRL.P No. 922 of 2026 4. FIR in the present case was registered against unknown persons after the dead body of an unknown person was found within the jurisdiction of Bengaluru Rural Railway Police Station. During the course of investigation, petitioner and other two accused were arrested and remanded to judicial custody. In the charge sheet, it is alleged that accused No. 1 - Satyavani, who was the wife of deceased Loganathan, subsequently had deserted him and married accused No. 2 - Varadaraj. Since Loganathan was insisting accused No. 1 to leave accused No. 2 and join him, accused Nos. 1 and 2 had allegedly conspired to commit the murder of Loganathan and on 19.02.2025, accused Nos. 1 and 2 took Loganathan to an isolated place within the limits of Bengaluru Rural Railway Police Station and committed his murder by assaulting him with machetes. 5. The allegation against the petitioner who is the friend of accused No. 2 is that he had helped accused Nos. 1 and 2 to shift the dead body and dispose of the same on - 5 - HC-KAR NC: 2026:KHC:29517 CRL.P No. 922 of 2026 the railway track within the jurisdiction of Bengaluru Rural Railway Police Station. Undisputedly petitioner had not participated in the act of committing the murder of Loganathan and the only allegation against him is about assisting accused Nos. 1 and 2 to shift the dead body. 6. Petitioner is in custody from 12.03.2025 onwards. It is submitted by the learned counsel for the petitioner that except the present case, petitioner has no other criminal antecedents. 7. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.135/2025 pending before the Court of I Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime - 6 - HC-KAR NC: 2026:KHC:29517 CRL.P No. 922 of 2026 No.10/2025 registered by the Bengaluru Rural Railway Police Station, for the offences punishable under Sections 103, 238 read with Section 3(6) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the date of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the - 7 - HC-KAR NC: 2026:KHC:29517 CRL.P No. 922 of 2026 case registered against him is disposed of.
