For the Respondents: Mr. Sikander Bhushan, Deputy Advocate General. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge Petitioner is serving as Lady Social Education Organizer in the respondent-Rural Development Department. Her grievance is to the office order dated 29.07.2026 (Annexure P-3), whereunder, she has been transferred to Development Block Narkanda, District Shimla against a vacant post of LSEO with TTA/Joining Time. Pursuant to the interim order passed in this petition on 05.08.2026, petitioner is continuing to serve at 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 her present place of posting, i.e. Development Block Mashobra, District Shimla. 2. The transfer has been assailed primarily on the grounds that the petitioner was posted at Development Block Mashobra, District Shimla only on 17.09.2025; She has just completed about ten months at her present place of posting at the time of issuance of the impugned office order. Further case of the petitioner is that the impugned office order has been issued on the basis of a specific D.O. note. 3. Respondents in their reply have not refuted the above allegations leveled by the petitioner. The incumbency position of the petitioner placed on record by the respondents reflects that prior to her posting at Development Block Mashobra, District Shimla w.e.f. 17.09.2025, the petitioner had served for full tenure of more than three years at Development Block Gagret, District Una. 4. In view of short stay of the petitioner at the present place of posting and keeping in view her allegation of having been transferred on the basis of D.O. note, there is substance in the case set up by the petitioner. Accordingly, this writ petition is allowed. The impugned 3 office order dated 29.07.2026 (Annexure P-3) is quashed and set aside.
