As per the case of the prosecution, the complainant lodged a report at Police Station Purani Basti, Raipur, alleging that on the date of the incident, a minor dispute arose between the accused persons and the injured person. Thereafter, the accused persons allegedly assaulted the injured, as a result of which he sustained simple injuries. Based on the said report, the police registered Crime No. 377/2025 against the present applicant and other accused persons for the offences punishable under Sections 296, 115(2), 109(1), 351(2), and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He would submit that co-accused Mithlesh Patel has been granted regular bail by this Court in MCRC. No.2713/2026 on 23/03/2026. He would submit that the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by this Court, applicant is a permanent resident of address mentioned in the cause title and there is no chance of his absconding, therefore he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that the applicant is the main accused who has caused injuries by knife on the neck of the injured who has suffered grievous injury. She would further submit that charge sheet has been filed against the applicant as an absconder, therefore, the anticipatory bail application of the applicant deserves to be rejected. 3 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the fact that applicant is the main accused who has caused injuries by knife on the neck of the injured who has suffered grievous injury, charge sheet has been filed against the applicant as an absconder and he has now come up before this Court for grant of anticipatory bail and also considering the fact that Supreme Court, in Lavesh v. State (NCT of Delhi), reported in {(2012) 8 SCC 730} and State of Madhya Pradesh v. Pradeep Sharma, reported in {(2014) 2 SCC 171}, has observed that where the accused has been declared as an absconder and has not cooperated with the investigation, he should not be granted anticipatory bail, therefore this Court does not find it to be a fit case to enlarge the applicant on anticipatory bail. 7. Accordingly, the anticipatory bail application of the applicant - Deepesh Pradhan, involved in Crime No.377/2025 registered at Police Station Puranibasti, Raipur District - Raipur (C.G.) for alleged commission of offence punishable under Sections 115(2), 296, 351(2), 109(1), 3(5) of BNS is rejected.
