GP FOR HOME The Court made the following: THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14626/2026 ORDER: This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking the following relief:- “to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the Official respondents 2 to 4 in not taking action against the 5th to 7th respondents in spite of complaint dated 10.05.2026 and 14.05.2026 to the 2nd and 3rd respondents as per the provision of chapter VIII of BNS, 2023 is illegal, arbitrary, and violative of Articles 14, 21 and 350 of the Constitution of India and consequently direct the official respondents 2 to 4 to register the crime against the respondents 5th to 7th on the compliant dated 10.05.2026 and 14.05.2026 and pass such other order or orders...’’ 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for the respondents. 3. Learned Assistant Government Pleader for Home furnished written instructions dated 21.05.2026 of the 3rd respondent, wherein it is stated that, based on the complaint dated 10.05.2026, a preliminary enquiry was conducted and it was found that the contents of the complaint relates to family transactions and are predominantly civil in nature. It is further stated that the 5th respondent had also filed a complaint containing similar allegations, and that a preliminary enquiry was conducted with reference to both complaints. 4. In view of the said instructions, since the Police have opined that the contents of the complaint do not disclose any cognizable offence and are civil nature, no action has been taken thereon. If the petitioner is aggrieved by the same, he has an alternative remedy of approaching the concerned learned jurisdictional Magistrate by filing an appropriate criminal petition. 5. With the above observations, the Writ Petition is disposed of. No order as to costs.
