2. Present is a writ petition under Article 227 of the Constitution of India SUMIT KUMAR Digitally signed by SUMIT KUMAR Date: 2026.06.19 10:50:06 +0530
2 filed by the petitioner for the following relief:- 10.1 That this Hon’ble court may kindly be pleased to call the record of the case for perusal of this Hon’ble Court. 10.2 That this Hon’ble Court may kindly be pleased to direct the learned Second Additional Principal Judge, Family Court, Durg (C.G.) to expedite and conclude the proceedings of Civil Suit No. 261/2023 filed by the petitioner, within stipulated time, in accordance with law. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.

Learned counsel for the petitioner would restricted his prayer that the learned Family Court may be directed to expedite the proceedings of the case No. 261/2023 which is pending since 10.03.2023 and the plaintiff as well as defendant’s witnesses have already been examined, however, the defendant has repeatedly taken time to produce her remaining witnesses.
4. I have heard learned counsel for the petitioner and perused the document annexed with the writ petition.

From perusal of the order sheet of the learned trial Court (Annexure P-2), it transpires that on 10.03.2023, the petitioner had filed an application under Section 13(i)(a)(ia) of the Hindu Marriage Act, 1955 for grant of divorce. The respondent made her appearance through her counsel then the issues have been framed on 22.02.2024 and the case was fixed for plaintiff’s evidence. The plaintiff was cross- examined on 09.01.2025, 10.03.2025, 01.05.2025 and 25.06.2025 and then the plaintiff’s evidence was closed, thereafter, the case was fixed
3 for defendant’s evidence on 14.07.2025, the defendant has been examined on 15.10.2025, thereafter, the case was fixed for her remaining witnesses on 10.11.2025, 03.12.2025, 07.01.2026, 05.02.2026, 20.02.2026, 12.03.2026 and 15.04.2026 but the defendant’s remaining witnesses could not be produced.

Considering the length of the proceedings and the proceedings of the learned trial Court, particularly considering that the plaintiff and defendant have already been examined and the case is only fixed for examination of remaining witnesses of the defendants, this Court is of the considered opinion that the learned Family Court may be directed to expedite the proceedings of the case.
7. Accordingly, the present writ petition is disposed of directing the Second Additional Principal Judge, Family Court, Durg to expedite the proceedings of case No. 261/2023 to conclude the same as early as possible within the period of four months from the next date fixed before it.
