JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.1 is before this Court calling in question proceedings in C.C.No.27054/2023, pending before the XLVII Additional Chief Metropolitan Magistrate, Bengaluru, for the offences under Section 420 of the IPC and Sections 43, 66 and 66B of the Information Technology Act, 2000. 2. Heard Sri Prasanna Rao, learned counsel appearing for the petitioner, Smt. B. Pushpalatha, learned Additional State - 3 - HC-KAR NC: 2026:KHC:13026 CRL.P No. 13211 of 2025 Public Prosecutor appearing for respondent No.1 and Sri A.T.Manohar, learned counsel appearing for respondent No.2. 3. Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have resolved the dispute and arrived at settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under Section 359 r/w. 528 of the BNSS along with affidavit of the petitioner and joint affidavit before this Court to this effect. 4. The affidavit of the parties reads as follows: “1. We submit that, the 1st of us being the petitioner filed the above petition praying to quash all the proceedings in Crime No.885/2023 of the South CEN Crime Police Station, for the Offences Punishable Under sections 43, 66, 66(b) of IT Act 2000 and Under Section 420 of IPC-1860 pending before Hon'ble 47th ACJM in CC No.27054/2023. 2. We submit that the 2nd of us being the complainant has earlier filed a complaint on 13/07/2023 before the 1st respondent police and the same was registered as Crime No.885/2023 against the 1st of us i.e. petitioner herein for offences punishable Under sections 43, 66, 66(b) of IT Act- 2000 and Under Section 420 of IPC-1860. - 4 - HC-KAR NC: 2026:KHC:13026 CRL.P No. 13211 of 2025 3. We submit that pursuant to police complaint, the 1st respondent police have filed charge sheet and the trial court has framed charge and posted the matter for trial. Upon the application filed by the 2nd of us the frozen amount of Rs.5,40,000/- came to be released by the trail court in favour of the 2nd of us. Meanwhile, the 1st of us i.e., the Petitioner along with my father have approached the 2nd of us i.e., the Respondent No.2 herein and requested for the settlement. After negotiations, the 2nd of us has agreed to consider the frozen amount Rs.5,40,000/- released in favour of the 2nd of us towards the settlement amount as a compensation towards huge loss caused to the software developed by the 2nd of us. WHEREFORE, we most respectfully pray that this Hon'ble court be pleased to quash the proceedings in C.C. No.27054/2023 pending on the file of Hon'ble 47th Additional Chief Judicial Magistrate, Bengaluru for offences punishable Under sections 43, 66, 66(b) of IT Act- 2000 and Under Section 420 of IPC-1860, in the ends of justice. In the light of the afore-quoted affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioner in the subject petition, as the allegations are not against the State. 5. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is allowed. (b) The proceedings in C.C.No.27054/2023, pending before the XLVII Additional Chief Metropolitan - 5 - HC-KAR NC: 2026:KHC:13026 CRL.P No. 13211 of 2025 Magistrate Court, Bengaluru, qua the petitioner, stand quashed.
