09.06.2026 Item No.32 Ct. No. 1 RP FMA 1490 of 2025 + IA No. CAN 1 of 2025 Nita Nandi (Mani) VS. The State of West Bengal & Ors. Mr. Prasad Bhattacharya Ms. Poulami Saha … For Appellant Mr. Kalyan Krishna Nandi …. Private Respondent appearing in person Mr. Ajit Kumar Misra, Ld. AGP Mr. Madhu Jana Ms. Puja Sarkar … For State Dictated by SUJOY PAUL, CJ.:- 1. Parties are represented by their respective learned counsels. 2. Heard on admission. 3. The challenge is mounted in this intra- Court appeal to the order dated 5.8.2025 passed by the learned Single Judge in WPA 16380 of 2025. In prayer (c) and (d) of the relief clause of the said writ petition the appellant/writ petitioner has prayed as under. “(c) A writ in the nature of mandamus or like nature be passed directing the 2 respondent nos.2, 3, 4 and 5 to stop giving police protection to the private respondent free of cost as the private respondent, without reason is misusing the same. (d) A writ in the nature of mandamus or like nature be passed directing the respondent nos.2, 3, 4 and 5 to stop allowing police personnel to enter inside Court room of Learned Courts at Bidhannagar, Barasat and Barrackpore Court Compounds;” 4. Learned counsel for the appellant fairly submitted that the police protection was granted to the private respondent pursuant to the order dated 28.7.2023 passed in CRR 913 of 2022. Thus, the question arises as to how the writ Court in its writ jurisdiction can grant relief which will amount to nullifying the order dated 28.07.2023 passed in CRR 913 of 2022. 5. Despite repeated query in this regard raised by the Court, no answer is forthcoming from the appellant. Thus, we 3 find no reason to entertain this Appeal. However, this order will not come in the way of the appellant to seek appropriate remedy if he is aggrieved by the order dated 28.07.2023 granting police protection in CRR 913 of 2022. 6. In the result, admission is declined and the appeal and the connected application are dismissed. (SUJOY PAUL, CJ.) (PARTHA SARATHI SEN, J.)
