ORAL ORDER
1. Accused in Crime No.37/2026 registered by Halagur Police Station, Mandya, for the offences punishable under Sections 108, 351(2) and 351(3) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.37/2026 was registered by Halagur Police Station, Mandya, for the aforesaid offences against the petitioner herein based on the first information dated 08.02.2026 received from Mahesha, husband of deceased Shakunthala and father of deceased Priya. In the said case, petitioner herein was arrested on 12.02.2026 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the Trial Court in Crl.Misc.No.174/2026 was rejected on 06.03.2026. Therefore, he is before this Court. - 3 -

Material on record would go to show that petitioner is a married man and he was staying with his family adjacent to the house of the first informant, who was also staying with his wife and children. In the first information, it is stated that petitioner, who is a married man had proposed to the daughter of first informant, who was aged about 18 years and therefore, first informant and his family members had advised the petitioner. Thereafter, they were making arrangements to perform the marriage of their daughter with a suitable boy. 5. On 07.02.2026, wife of the first informant informed him that petitioner who came to their house had allegedly threatened them with dire consequences if they get their daughter married to some other boy. Subsequently on 08.02.2026, the wife and daughter of the first informant had committed suicide. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. 6. Remand application of the petitioner which is available on record would go to show that, on 06.02.2026 itself, petitioner was admitted in K. R. Hospital, Mysuru, after he had consumed some pesticides at about 01.30 p.m. on the said day. He was

discharged from the Hospital only on 12.02.2026.
Wife and daughter of the first informant had committed suicide in their house by hanging themselves on 08.02.2026, which is much after the petitioner was admitted in the Hospital with a history of he consuming some poisonous substance. The petitioner, who is a married man, having family, is in custody from
12.02.2026. Investigation of the case is completed and charge sheet has been filed. In view of the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.37/2026 registered by Halagur Police Station, Mandya, for the offences punishable under Sections 108, 351(2) and 351(3) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
