NARAYANNAPPA, AGED ABOUT 56 YEARS, R/O.NARAYANAMMA COLONY ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondent No.4 to 8 in interfering with my rights and possession over the house in the house site in an extent of Ac.0-01.50 cents in Sv.No.24/2B of Mallapalle Village, Gorantia Mandal, Satya Sai District and high handed action of the respondent No.5 to 8 contemplating to disposes me from the subject land at the behest of the respondent No.9, as highly illegal, arbitrary and violative of fundamental and constitutional rights guaranteed to me under Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondent Nos.4 to 9 not to interfere with my right, peaceful possession and enjoyment over the house in an extent of Sy.No.24/2B of Mallapalle Village, Gorantia Mandal, Satya Sai District and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents not to interfere with my right, peaceful possession and enjoyment over the house in the house site in an extent of Ac.1.50 cents in Sv.No.24/2B of Mallapalle Village, Gorantia Mandal, Satya Sai District, pending disposal of the above Writ Petition and pass Counsel for the Petitioner: 1. GP FOR REVENUE 3 BKM,J W.P.No.13652 of 2026 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4. 2. The issuance of notice to the 9th respondent is dispensed with as no prejudice would cause to him even if it is disposed of in his absence. 3. This writ petition is filed questioning the action of the respondent Nos.4 to 8 in interfering with the petitioner’s rights and possession over the house site in an extent of Ac.0-01.50 cents in Sy.No.24/2B of Mallapalle Village, Gorantla Mandal, Satya Sai District and highhanded action of the respondent Nos.5 to 8 in contemplating to dispossess her from the subject land at the behest of the respondent No.9. 4. On the other hand, the learned Assistant Government Pleader for Revenue relying upon the written instructions of the 4th respondent dated 06.05.2026 submits that the subject land situated in Sy.No.24/2B of Mallapalle Village, Gorantla Mandal is under dispute with multiple claims relating to the house site patta and possession. One Sri G. Ramakrishna submitted representations stating that the land was originally granted to his family and alleging encroachment. Based on such petitions, enquiry was conducted through the Village Revenue Officer. During the enquiry, it was found that, old patta records exist but relevant documents are not fully traceable and there are competing claims over the same land. However, the 4th respondent has 4 BKM,J W.P.No.13652 of 2026 not passed any eviction order against the petitioner and no attempt has been made to dispossess her without following the due procedure. 5. In view of the above said facts and circumstances, recording the said instructions of the 4th respondent dated 06.05.2026, no further orders are necessary in this writ petition. The said written instructions of the 4th respondent dated 06.05.2026 shall be made as part of the Court record. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
